[Domestic Policy] The pressure on #Bolsonaro in #Brazil is growing 2019-06-19

In Brazil the pressure on the government of President Jair Bolsonoro (Partido Social Liberal/PSL) has increased. On June 9, The Intercept has released several incriminating documents. These show agreements that are close to illegal between the prosecutors and the judge Sergio Moro against the former President Luiz Inacio Lula da Silva (Labor Party, Partido dos Trabalhadores/PT). Afterwards the former Judge and current Minister of Justice of Brazil Moro has coordinated with prosecutors and instructed them to arrest former President Lula da Silva (Labor Party, Partido dos Trabalhadores/PT).

What happened until now

Since 2014 the predecessor of Rousseff Luiz Inacio Lula da Silva (Labor Party, Partido dos Trabalhadores/PT) is accused of corruption. Lula da Silva is accused of overseeing a system of corruption in which among other bribes were paid to obtain lucrative orders from the state-owned oil company Petrobras.

The investigators initially did not accuse him of receiving bribes. Investigators accused him of paying bribes to Petrobras leaders, members of the Labor Party (Partido dos Trabalhadores/PT) and MPs to ensure continued government by the Labor Party (Partido dos Trabalhadores/PT).

During the presidential campaign of 2018 Lula da Silva was again accused of corruption in connection with Petrobras. The anti-corruption judge Sergio Moro found Lula da Silva guilty of having personaly accepted bribes. On September 1, 2018 Lula da Silva was then prohibited from participating in the 2018 presidential election. Thus an election victory of the Labor Party (Partido dos Trabalhadores/PT) in 2018 was de facto prevented. See: Brazil

The first Consequence

As a first consequence Bolsonoros (Partido Social Liberal / PSL) Secretary of State and General Carlos Alberto dos Santos Cruz was dismissed on June 13, 2019. General dos Santos Cruz was considered a pragmatist who warned against extremism and fanaticism and was said to have been in a continuous dispute with Bolsonaro's son Carlos. The move came after Bolsonoro (Partido Social Liberal/PSL) broke his silence after four days regarding the charges against Moro. [1] [2]

The former judge and current Minister of Justice of Brazil Moro sees himself in parallel with the growing demand for a resignation. Moros reputation in public has deteriorated greatly because of the publications. But Bolsonoro (Partido Social Liberal/PSL) announced via a spokesman that Moro enjoys the full confidence of him. [3]

A Mock Trial

The investigation around the state-owned company Petrobras are also referred to as "Car Wash" (Lava Jato) and are considered one of the biggest political scandals in Brazil. But with the recent publications doubts about the investigation have increased. The Intercept publications that even investigators had massive doubts that the evidence is sufficient to prove misconduct of Lula da Silva (Partido dos Trabalhadores/PT). The publications of The Intercept contain messages via Telegram show that Moro has cooperated as a judge with the investigating prosecutors on how best to incriminate Lula and prevent an electoral victory of his Labor Party (Partido dos Trabalhadores/PT). This is particularly difficult as the conviction of Lula da Silva (Partido dos Trabalhadores/PT) caused Bolsonoro (Partido Social Liberal/PSL) to win the presidential election in October 2018. Today’s articles show, among other things, that the Car Wash prosecutors spoke openly of their desire to prevent the PT from winning the election and took steps to carry out that agenda, and that Moro secretly and unethically collaborated with the Car Wash prosecutors to help design the case against Lula despite serious internal doubts about the evidence supporting the accusations, only for him to then pretend to be its neutral adjudicator. Following the publication of The Intercept Judge Moro gave prosecutor Deltan Dallagnol instructions on how to conduct the investigation against Lula da Silva (Partido dos Trabalhadores/PT). Moro and Dallagnol are also said to have leaked a phone conversation between Lula da Silva (Partido dos Trabalhadores/PT) and his successor Dilma Rousseff (Partido dos Trabalhadores/PT) to the press although the release of the recordings would be illegal and both subsequently congratulated each other for the coup. In addition Dallagnol has allegedly confirmed that there is no evidence that Lula da Silva (Partido dos Trabalhadores/PT) has received the property from the construction company OAS in return for orders from the state-owned company Petrobras. That's why one has to prepare a watertight discourse. Then Moro and Dallagnol should have used tricks so that Moro and not to another judge would judge Lula da Silva (Partido dos Trabalhadores/PT). [4]
The Car Wash prosecutors explicitly said that their motive in stopping Lula’s interview was to prevent the PT from winning. One of the prosecutors, Laura Tessler, exclaimed upon learning of the decision, “What a joke!” and then explained the urgency of preventing or undermining the decision. “A press conference before the second round of voting could help elect Haddad,” she wrote in the chat group, referring to the PT’s candidate Fernando Haddad. The chief of the prosecutor task force, Deltan Dallagnol, conducted a separate conversation with a longtime confidant, also a prosecutor, and they agreed that they would “pray” together that the events of that day would not usher in the PT’s return to power. [5]
Lula da Silva (Partido dos Trabalhadores/PT) is accused of having accepted a property in return for lucrative orders from the state-owned company Petrobras to the construction company OAS. However Lula da Silva (Partido dos Trabalhadores/PT) always asserted his innocence. According to The Intercept Deltan Dallagnol the head of the investigation expressed growing doubts a few days before the prosecution's assertion that the property was actually owned by Lula da Silva (Partido dos Trabalhadores/PT) and had nothing to do with Petrobras. This move could lead to Lula da Silva (Partido dos Trabalhadores/PT) being released from prison and in any case questions the legitimacy of the presidential election in October 2018. [5] [6]
Other chats in the archive raise fundamental questions about the quality of the charges that ultimately sent Lula to prison. He was accused of having received a beachfront triplex apartment from a contractor as a kickback for facilitating multimillion-dollar contracts with the state-controlled oil firm Petrobras. In group chats among members of the prosecutorial team just days before filing the indictment, Dallagnol expressed his increasing doubts over two key elements of the prosecution’s case: whether the triplex was in fact Lula’s and whether it had anything to do with Petrobras. The claim Lula da Silva (Partido dos Trabalhadores/PT) and his wife Marisa Leticia received a property came from a report by O Globo from 2010. In this report it was not about corruption that already occurred but the dangers for buyers of houses because the original construction company Bancoop went bankrupt and the completion was on hold and the subsequent builder OAS offered the affected persons better equipped apartments as compensation. However the couple ultimately rejected this offer. [6] [8]

The Source

It is unclear where The Intercept received the documents from. According to their own information they received the documents several weeks before Moros phone was hacked. And the Intercept defends the use and selective publication with the public interest. [4]

Following the publication, co-author and editor-in-chief of The Intercept Glenn Greenwald was vaguely threatened by MP Carlos Jordy (Partido Social Liberal/PSL). Jordy (Partido Social Liberal/PSL) offered Greenwald a stage and announced that the case is already under investigation. [9] However Jordy (Partido Social Liberal/PSL) did not tell whether he meant the publications or their content. [10] He also accused Greenwald of committing a crime and warned him not to confront institutions and authorities and to commit crimes against national security. [11] [12]
