[Foreign Policy] Aachen Treaty 2019-01-27

On January 22, 2019 in Aachen Chancellor Angela Merkel and President Emmanuel Macron signed the Treaty of Aachen. The treaty promotes German-French cooperation and integration and is divided into six chapters.

1. European Affairs
2. Peace, security and development
3. Culture, Education, Research and Mobility
4. Regional and cross-border cooperation
5. Sustainable Development, Climate, Environment and Economic Affairs
6. Organization

The measures agreed in the Treaty are of minor importance and the proposals for Eurozone reform have been canceled. The treaty does not foresee a minister of finance, a budget or a parliament for the euro zone. The most far-reaching goal is to develop both economies into a German-French economic area with common rules. Thus the concept of a core EU and different fast-developing zones in the EU makes a return. After Macron started as the savior of the EU he now has to be accept with little things.

Artikel 20/Article 20

(1) Beide Staaten vertiefen die Integration ihrer Volkswirtschaften hin zu einem deutsch-französischen Wirtschaftsraum mit gemeinsamen Regeln. Der Deutsch-Französische Finanz- und Wirtschaftsrat fördert die bilaterale Rechtsharmonisierung, unter anderem im Bereich des Wirtschaftsrechts, und stimmt die wirtschaftspolitischen Maßnahmen zwischen der Bundesrepublik Deutschland und der Französischen Republik regelmäßig ab, um so die Konvergenz zwischen beiden Staaten zu befördern und die Wettbewerbsfähigkeit ihrer Volkswirtschaften zu verbessern.
(2) Beide Staaten richten einen deutsch-französischen „Rat der Wirtschaftsexperten“ ein, der sich aus zehn unabhängigen Fachleuten zusammensetzt und das Ziel verfolgt, ihren Regierungen wirtschaftspolitische Empfehlungen zu unterbreiten.

(1) Both countries are deepening the integration of their economies towards a German-French economic area with common rules. The Franco-German Financial and Economic Council promotes bilateral legal harmonization, including in the field of commercial law, and regularly coordinates the economic policy measures between the Federal Republic of Germany and the French Republic in order to promote convergence between the two countries and the competitiveness of their economies to improve.
(2) Both countries are setting up a Franco-German "Council of Economic Experts" composed of ten independent experts with the aim of providing their governments with economic policy recommendations. [1,S.13]

On the other hand the militaristic agreements in the treaty are more extensive. According to the treaty both countries want to develop a common foreign and military policy and with a view to joint military operations a common strategic culture. This reappears the concept of a core EU and rapidly developing zones in the EU. Here however the German government would make concessions to the French government as the former relied so far on a common militarization of the EU. Basically the foreign and military policy approaches of the Treaty only confirm the previous militarization of the EU in the form of joint arms projects and the intensification of military cooperation such as military cooperation the so-called Permanent Structured Cooperation PESCO.

Artikel 4/Article 4

(1) In Anbetracht ihrer Verpflichtungen nach Artikel 5 des Nordatlantikvertrags vom 4. April 1949 und nach Artikel 42 Absatz 7 des Vertrags vom 7. Februar 1992 über die Europäische Union, geändert durch den Vertrag von Lissabon vom 13. Dezember 2007 zur Änderung des Vertrags über die Europäische Union und des Vertrags zur Gründung der Europäischen Gemeinschaft, nähern die beiden Staaten, überzeugt davon, dass ihre Sicherheitsinteressen untrennbar miteinander verbunden sind, ihre sicherheits- und verteidigungspolitischen Zielsetzungen und Strategien einander zunehmend an und stärken so auch die Systeme kollektiver Sicherheit, denen sie angehören. Sie leisten einander im Falle eines bewaffneten Angriffs auf ihre Hoheitsgebiete jede in ihrer Macht stehende Hilfe und Unterstützung; dies schließt militärische Mittel ein. Die territoriale Reichweite nach Satz 2 entspricht derjenigen nach Artikel 42 Absatz 7 des Vertrags über die Europäische Union.
(3) Beide Staaten verpflichten sich, die Zusammenarbeit zwischen ihren Streitkräften mit Blick auf eine gemeinsame Kultur und gemeinsame Einsätze weiter zu verstärken. Sie intensivieren die Erarbeitung gemeinsamer Verteidigungsprogramme und deren Ausweitung auf Partner. Hierdurch beabsichtigen sie, die Wettbewerbsfähigkeit und Konsolidierung der europäischen verteidigungstechnischen und -industriellen Basis zu fördern. Sie unterstützen die engstmögliche Zusammenarbeit zwischen ihren Verteidigungsindustrien auf der Grundlage gegenseitigen Vertrauens. Beide Staaten werden bei gemeinsamen Projekten einen gemeinsamen Ansatz für Rüstungsexporte entwickeln.
(4) Beide Staaten richten den Deutsch-Französischen Verteidigungs- und Sicherheitsrat als politisches Steuerungsorgan für diese beiderseitigen Verpflichtungen ein. Dieser Rat wird regelmäßig auf höchster Ebene zusammentreten.

In the event of an armed attack on their territories they shall render each other assistance and assistance in their power this includes military means. The territorial scope of sentence 2 is the same as that under Article 42 (7) of the Treaty on European Union.
(3) Both countries undertake to further strengthen cooperation between their armed forces with a view to a common culture and joint missions. They intensify the development of common defense programs and their extension to partners. In doing so they intend to promote the competitiveness and consolidation of the European defense and industrial base. They support the closest possible cooperation between their defense industries on the basis of mutual trust. Both countries will develop a common approach to armaments exports in joint projects.
(4) Both states set up the German-French Defense and Security Council as a political steering body for these mutual obligations. This Council will meet regularly at the highest level. [1,S.5]

At the same time the foreign and military policy approach promises great influence for Germany. The French government promises to carry out a stronger exchange between the Security Council staffs of the two countries and to coordinate their respective positions. In addition the French government promises to work for a permanent seat of the German government in the UN body.

Artikel 5/Article 5

Beide Staaten weiten die Zusammenarbeit zwischen ihren Außenministerien, einschließlich ihrer diplomatischen Missionen und konsularischen Vertretungen, aus. Sie werden Austausche zwischen ihrem Führungspersonal durchführen. Sie werden Austauschprogramme zwischen ihren Ständigen Vertretungen bei den Vereinten Nationen in New York, insbesondere zwischen den Sicherheitsratsstäben, den Ständigen Vertretungen bei der Nordatlantikvertrags-Organisation und den Ständigen Vertretungen bei der Europäischen Union sowie zwischen den für die Koordinierung der europapolitischen Maßnahmen zuständigen Stellen beider Staaten einrichten.

Both countries extend cooperation between their foreign ministries, including their diplomatic missions and consular posts. They will carry out exchanges between their leaders. They will set up exchange programs between their Permanent Representations to the United Nations in New York, in particular between the Security Council Staff, the Permanent Representations to the North Atlantic Treaty Organization and the Permanent Representations to the European Union and between the bodies responsible for coordinating European policies. Artikel 8/Article 8

(2) Beide Staaten verpflichten sich zur Fortsetzung ihrer Anstrengungen, zwischenstaatliche Verhandlungen über die Reform des Sicherheitsrats der Vereinten Nationen abzuschließen. Die Aufnahme der Bundesrepublik Deutschland als ständiges Mitglied des Sicherheitsrats der Vereinten Nationen ist eine Priorität der deutsch-französischen Diplomatie.

(2) Both countries pledge to continue their efforts to conclude intergovernmental negotiations on the reform of the United Nations Security Council. The admission of the Federal Republic of Germany as a permanent member of the United Nations Security Council is a priority of German-French diplomacy. [1,S.8]

The German-French partnership is weakened. The Treaty of Aachen shows on the one hand how little one can hope for a solution to the economic problems in the EU. On the other hand the Treaty of Aachen shows the importance of militarization in the EU. The Federal Chancellor who has just announced the end of her government meets the disenchanted president. The people who demonstrated against both had only boos and whistles left for them.
