The Zentrum für politische Schönheit (Center for Political Beauty) is a collective of about 70 artists. According to their own statements the goal is to draw attention to humanitarian issues through actions and to remember the protection of human lives. For this they have put a replica of the Holocaust Memorial in front of a politician's house and publicly called to quit the job of participants of a demonstration. However they have never said anything against the successful and ongoing regime-change in the Ukraine and Venezuela, against the arrest of Julian Assange or Chelsea Manning, against the Ramstein Air Base on German soil with which drones are controlled or against the use of radioactive uranium ammunition. After it became public at the beginning of April 2019 that the Center for Political Beauty was being investigated against for forming a criminal organization the Center for Political Beauty saw itself as a victim of perverting the course of justice. Upon closer inspection however much suggests that the government interventioned with the judiciary and in favor of the Center for Political Beauty. See: Center for Political Beauty [1]

Holocaust Memorial

When activists from the Zentrum für politische Schönheit (Center for Political Beauty) had placed a copy of the Holocaust memorial in front of the house of AfD Politician Björn Höcke from Thuringia in November 2017 the press saw no problem. During an appearance in Dresden Höcke had called the Berlin monument a "monument of shame". The Zentrum für politische Schönheit (Center for Political Beauty) had then built a small replica on a neighboring site of Höckes residence and funded it by a fundraiser. However it is unclear how Höcke should have called the Holocaust a shame. For anyone who calls the Holocaust less than a shame is suspicious of historical revisionism. [2]

Soko Chemnitz

On December 3, 2018 the Center for Political Beauty (Zentrum für politische Schönheit/ZPS) published the project Soko Chemnitz. The goal was to identify those who demonstrated in Chemnitz after the murder of Daniel H. and to report them to their employers. The goal was to make the suspects lose their jobs. The ZPS demanded directly to denounce colleagues, neighbors and acquaintances. [3] [4] The ZPS justifies its actions by saying that criticism of immigration is illegitimate and that the AfD is undemocratic. Unspoken it is assumed that the demonstrators are voters of the AfD. Thus the ZPS builds up an oversized straw man to justify his own deeds. [5]

But in Germany the right of assembly still applies. [6] The dissemination of false facts against better knowledge in relation to another person fulfills the offense of slander. [7] And the call for denunciations fulfills the offense of the public call for criminal offenses. [8] [9] Therefore the actions of the ZPS are clearly illegal.

The Criminal Charge

First the head of the Center for Political Beauty Philipp Ruch was banned in March at an event organized by the Federal Agency for Civic Education (Bundeszentrale für politische Bildung). It was planned that Ruch to appear at a congress of the Federal Agency for Civic Education. However on the instructions of the Federal Ministry of the Interior to which the Federal Agency for Civic Education is subordinate prohibited his appearance. According to the Federal Ministry of the Interior the invitation of Ruch could be misunderstood as legitimizing of the actions. Ruch already saw this as censorship and said that it was an attempt to silence him. [10] [11]

Shortly thereafter it became known from a parliamentary inquiry that it is being investigated against the Center for Political Beauty. The suspicion is the formation of a criminal association under section 129 of the Criminal Code. The investigation was taken one week after the action in November 2017 in which a replica of the Holocaust Memorial was placed next to the home of the MP of the AfD Björn Höcke from Thuringia. The investigation was ended in April 2019 after they were made public on instructions from Thuringia's Justice Minister Dieter Lauinger (Green-Party). First the investigation in the press was portrayed as a scandal and then the investigating prosecutor was moved into the vicinity of the AfD since he once donated 30 euros to them with his private e-mail address. This is questionable on several levels. All state employees have different political opinions. And in the same way one could now accuse Justice Minister Lauinger (Green-Party) of being biased because of his party affiliation. But if a political opinion is delegitimized without at least a suspicion of a crime, then there is the implicitly of a political purge. [17] [18] [19] [20] [21]

The Order

The action of the Thuringian Minister of Justice Lauinger (Green-Party) is questionable twice. On the one hand it undermines the independence of the judiciary since after the SOKO Chemnitz is sufficient reason against the center for political beauty. On the other hand Thuringia's Justice Minister Lauinger (Green-Party) has severely restricted himself in January 2017 with a decree. According to this it is only very generally possible for the Minister of Justice to give instructions but not to order the admission or suspension of criminal proceedings at the public prosecutor's offices. Im Ergebnis einer heute stattgefundenen Besprechung der Leitung der Staatsanwaltschaft Gera, dem Generalstaatsanwaltschaft und dem Thüringer Justizminister Dieter Lauinger (BÜNDNIS 90/DIE GRÜNEN) besteht zwischen allen Teilnehmern Einigkeit in folgenden Punkten.

Das Ermittlungsverfahren gegen Dr. Philipp Rauch wegen Bildung einer kriminellen Vereinigung (§ 129 StGB) u.a. wird nach § 170 Abs. 2 StPO eingestellt.

Der ermittelnde Staatsanwalt wird auf eigenen Wunsch vorläufig bis zu endgültigen Klärung der medial gegen ihn erhobenen Vorwürfe mit anderen Aufgaben in der Staatsanwaltschaft Greta betraut. Eben wird er von seinen Aufgaben als Pressesprecher der Staatsanwaltschaft Gera entbunden.

As a result of today's meeting of the management of the prosecutor Gera, the Attorney General's Office and the Thuringian Minister of Justice Dieter Lauinger (The Green-Party) there is agreement between all participants in the following points.

The preliminary investigation against Dr. Philipp Rauch because of formation of a criminal union (§ 129 StGB) u.a. is closed according to § 170 Abs. 2 StPO.

The investigating prosecutor is entrusted at his own request for the time being until final clarification of the media charges against him with other tasks in the prosecutor's office Greta. He is just released from his duties as spokesman for the prosecutor Gera.

Meanwhile the Center for Political Beauty still sees itself in the role of the victim. [25]

Wenn wir das Vorgehen gegen das Zentrum mit etwas Distanz betrachten: Erhalten wir hier einen Ausblick auf eine postdemokratische, in Faschisierung begriffene Bundesrepublik, in der die Rechte die Hegemonie errungen hat?

ZPS: Die Faschisierung schreitet voran. Bundeswehr, Polizei, jetzt die Justiz. Wenn die demokratischen Schutzmechanismen nicht einsetzen, fühlen sich Nazis in sämtlichen Positionen ermutigt. Die NSDAP hatte 1928 auch erst 2,63%. Die AfD sitzt bereits mit 12% im Bundestag, sitzt in Gremien und nimmt gesellschaftlichen Einfluss. Die Mehrheit der Deutschen wähnt sich sicher, aber Handeln ist jetzt nötig, nicht erst, wenn es zu spät ist.

If we look at the approach against the center with some distance: Are we getting an idea of a post-democratic, fascist Federal Republic in which the right has won the hegemony?

ZPS: The fascization is progressing. Bundeswehr, police, now the judiciary. If democratic protections does not materialize Nazis in all positions feel encouraged. The NSDAP had in 1928 also only 2.63%. The AfD already sits with 12% in the Bundestag and sits on committees and pursues social influence. The majority of Germans think they are safe, but action is needed now not only when it's too late. [25]
