[Domestic Policy] The third manhunt in Chemnitz - Perverting the course of justice 2019-04-19

On August 25, 2018 Daniel H. was murdered in Chemnitz and two others were injured. According to the police the three victims were attacked without any need for self-defense. [1] [2] It was being investigated against three asylum seekers Farhad A., Alaa S. and Yousif A. from Iraq. Farhad A. is a criminal convicted of theft, drug trafficking and assault. [3] In addition Farhad A. was supposed to leave and should have been deported. [4] Yousif A. presented fake documents and Alaa S. was recognized unchecked as a refugee. [5] Several days after the murder there were demonstrations and the federal government spoke of manhunts on foreigners and gatherings (Zusammenrottungen) that were not to be tolerated. After the head of the domestic intelligence service (Bundesamts für Verfassungsschutz) Hans-Georg Maaßen was hunted out of office under false pretenses in the first manhunt dissenters were denounced by the Center for Political Beauty in the second manhunt. In a third manhunt a criminal case turns into a farce which shows the failure of German asylum policy and justice. See: Center for Political Beauty

Suspect: Yousif A.

The original suspect Yousif A. was released after several weeks in custody for lack of evidence. Yousif A. was released after he filed a criminal complaint against the responsible prosecutors. He had been detained without urgent suspicion and accused them of right-wing and deprivation of liberty. [8] [9]

Suspect: Farhad A.

The suspect Farhad A. is on the run and is being searched for with an international arrest warrant. It is assumed that at least he has stabbed Daniel H. the victim that died. [8] Farhad A. had an extensive criminal record even before the murder of Daniel H. although he lived in Germany for only two years.

• November 19, 2016: Farhad A. stole money and tickets from the team leader's office of his accommodation for unaccompanied minor refugees in Chemnitz.
• November 20, 2016: Farhad A. stole from the room of another refugee two pairs of shoes and a straightener to style her hair.
• November 23, 2016: Farhad A. stole goods worth nearly five euros in a shopping market.
• Dezember 12, 2016: Farhad A. stole a pair of Adidas sneakers in the department store department.
• January 28, 2017: Farhad A. stole food in a supermarket for more than 40 euros.
• February 1, 2017: Because no one had a cigarette for Farhad A. he hit a juvenile German guest in the face and then attacked the seller with a knife. According to police protocol he added four puncture and cut injuries to the seller before the seller managed to break the blade. The prosecutors office of Chemnitz therefore initiated an investigation against Farhad A. for dangerous bodily injury.
• March 2, 2017: Farhad A. loomed threateningly before a young German man insulted and attacked him. He hit the face of the young German woman with the palm of his hand. He spit in the face of another German woman.
• April 26, 2017: Farhad A. drove in Chemnitz without a ticket by public transport.
• April 27, 2017: Farhad A. broke a door with bare feet in the Chemnitz asylum home after being caught in a theft.
• July 4, 2017: Farhad A. was caught with 15 grams of marijuana which he had bought in Leipzig for 100 euros. Because of this act the district court Stollberg later sentenced him to a prison term of four months - but on probation.
• August 2, 2017: Farhad A. went for a 16-year-old and threatened him: If the police were not here I'd kill you!
• 4. Dezember 2017: Farhad A. fought another refugee and punched him in the face while being drunk; The home management in Crottendorf in Saxony called the police to help.

[18] [18,archive] In January 2017 the application for asylum from from Farhad A. was rejected by the Federal Office for Migration and Refugees (Bundesamt für Migration und Flüchtlinge/BAMF). In addition the Federal Office for Migration and Refugees stated that there were no deportation bans and that Farhad A. on his return to Iraq, was not threatened with any danger to life and limb or economic hardship. In July 2018 his temporary toleration to stay expired. Nevertheless measures to end him staying in Germany were not carried out and were not planned. [18] [18,archive]

The case of Farhad A. exemplifies how German asylum policy fails. Although it was clear early on that Farhad A. is a walking security risk no one has responded. Authorities have created new investigative procedures, documented each offense and the 14 aliases of him. His actions remained without consequences. However a DNA sample from Farhad A. was never collected. [19] [19,archive]

According to the final investigation report of the Chemnitz police neither Daniel H., Farhad A. nor their surroundings had any contact with each other before the crime. According to the police the deadly attack was therefore a spontaneous act. [20] [20,archive] Daniel H. died on August 26, 2018 at 04:04 o'clock. [21] At the tip of the knife blood from Dimitri M. and clear features of Daniel H. were detected. According to the investigators Daniel H. and then Dimitri M. were stabbed. An incomplete DNA trace was detected on the knife handle indicating towards Farhad A. Since Farhad A. is still on the run and no DNA sample was taken from him this is still unconfirmed. [22]

Suspect: Alaa S.

The suspect Alaa S. is said to have stabbed Daniel H. on the edge of the city festival in Chemnitz in a dispute with a knife. The prosecution accuses Alaa S. of committing manslaughter in the majority of the act with attempted manslaughter and dangerous assault. According to the prosecutor he at least accepted to deadly hurt the two victims. [7] [8] [9] Alaa S. however denies the act and claims to have been not at the scene of the crime at the time. The defense of Alaa S. therefore requested the end of the proceedings and a lifting of the arrest warrant. [9] [14] And indeed no trace of Alaa S. was found on the knife with which Dimitri M. and Daniel H. were stabbed. [22] Immediately after the crime Alaa S. had fled with another suspect before being caught by the police. When asked why he had fled Alaa S. said that he was afraid of the police. It is also questionable why blood stuck to his hands during his arrest. According to the investigation the blood was not from Daniel H. or Dimitri M. but most likely from Alaa S. himself. [25]

Lawyer: Ricarda Lang

The suspect Alaa S. denies the act and is defended by the lawyer Ricarda Lang. Lang in turn requested the case to be closed and the arrest warrant to be set aside as there was a lack of strong evidence. She also doubts the independence of the court. [12] [14]

Even before the indictment was read Lang presented a questionnaire. In this questionnaire by Lang the judges were supposed to state whether they are members or supporters of the AfD or Pegida. From her point of view she has a right to know this and from her point of view an affiliation would resault in an unfair procedure. [12] [14]

According to her own statements Ricarda Lang regularly defends suspects from the Arab world. Including alleged or actual members of criminal clans. Of course no one submitted a questionnaire to Ricarda Lang because of that. And neither the AfD nor Pegida are banned in Germany or are observed by the domestic intelligence service (Bundesamts für Verfassungsschutz). The court has therefore rejected information on the political views of the judges. [13] [26]

Victim: Dimitri M.

Dimitri M. was seriously injured and is together with the mother and sister of the killed Daniel H. as a co-plaintiff. Dimitri M. has suffered a three to four centimeters deep knife stab in the back. However he hardly remembers the events of the crime. [10] [11]

According to Dimitri M. they met several asylum seekers who demanded cigarettes from them on the way home. Then there was a brief exchange of words that ended with an attack. According to Dimitri M. Daniel H. was hit with the palm of a hand in the face and was stabbed while was already on the ground. [11]

Witness: Younes N.

Younis al-N. is the first witness. At the police Younis al-N. clearly recognized Alaa S. and the still elusive Farhad A. as the persons who attacked Daniel H. jointly. At the police he admitted that he did saw a typical stab movement but not a knife. [15]

During the trial Younis al-N. however surprisingly refused to testify which now threatens the process to fail in the worst case. [14] In addition Younis al-N. stated by the investigating judge to have been threatened because of his testimony. His lawyer Ulf Israel stated that his client denies his testimony according to section 55 of the right to refuse information. Younis al-N. will only make general statements about the crime but not about the crime itself. [15] [16] [17]

The public prosecutor of Chemnitz has thus brought charges against an interpreter involved in the proceedings for attempted incitement to false statements. The interpreter is accused of influencing Younis al-N. so that he withdraws from his first statement with the police. The interpreter is said to have not acted on behalf of the detained suspect Alaa S. but his girlfriend. [23] [24]

Younes al-N. was repeatedly threatened and assaulted once. According to Younes al-N. on November 19, 2018 the friend of the detained Alaa S. appeared at the bar where he works and asked for a meeting. At this meeting the interpreter has stated that the statements of Younes al-N. were not correct. Younes al-N. however stayed with his statement. The interpreter confirmed to the police that the meeting took place but according to his own information he was not trying to influence the witness. The interpreter is said to have become involved in the questioning but also entangled himself in contradictions about how the contact with the friend of Alaa S. came about. A note from the Chemnitz police said that it was necessary to doubt the integrity of the interpreter. [23] [24]

However the alleged influence of the interpreter would not be the only case were Younes al-N. was been threatened. Younes al-N. received several death threats from the accused Alaa S. and was forced by a larger group to swear the truth on the Koran. Out of fear Younes al-N. now refuses to testify in court as a witness. [23] [24]
